Regulations of Jilin Province on Frontier Administration
(Adopted at the 6th session of the Standing Committee of the 8th People's Congress of Jilin Province on November 12, 1993)

Chapter 1 General Provisions
Article 1 With a view to strengthening the administration of frontier, safeguard state sovereignty and territorial integrity, maintaining the peace and stability in frontier regions, properly dealing with frontier-related matters, promoting the reform and opening to the outside world as well as economic development in frontier regions, enhancing the good-neighborly and friendly relations with the neighboring country. These Regulations are formulated in accordance with the provisions of the relevant laws and regulations and on the basis of the actual situation of this Province.
Article 2 All organizations, Chinese citizens, foreigners and stateless persons who reside in, pass through or carry out production or other activities in the frontier regions of this Province shall comply with these Regulations.
For the purpose of these Regulations, frontier regions shall mean the administrative areas of the cities located along the national boundary.
Article 3 All Chinese organizations and citizens are obliged to defend the national boundary, protect the national boundary marker and relevant facilities, and maintain the social order and security in frontier regions.
Article 4 People’s governments at various levels shall strengthen the leadership on works relating to frontier administration, and frontier defense committees at various levels shall be responsible for carrying out coordination for works relating to frontier administration.
Foreign affairs departments, public security organs and frontier defense army are frontier administration departments, and they shall organize the implementation of these Regulations according to their respective functions and responsibilities.
Chapter 2 Administration of National Boundaries
Article 5 Without authorization, no organization or individual may damage, move or dismantle any national boundary marker.
With respect to national boundary markers, any abnormal situation found shall be duly reported to frontier administration departments, and may not be handled without authorization.
The restoration, repair or reconstruction of national boundary markers shall be carried out in accordance with the agreement concluded by and between this Country and the neighboring country or the relevant provisions of the State.
Article 6 The clean-up of national boundary visibility roads shall be duly carried out in accordance with the agreement concluded by this Country and the neighboring country.
Article 7 Without authorization, no organization or individual may carry out any activity which is to change or is likely to change the flow direction of national boundary or is to or is likely to affect the stability of boundary river.
Article 8 The construction of any traffic, telecommunication, water conservation, power supply, survey, environmental protection or other engineering facility which strides across the national boundary shall be reported to the consent from the Provincial People’s Government and the approval from the competent departments of the State, and such facilities shall be constructed, managed and maintained in accordance with the agreement concluded by this Country and the neighboring country.
Chapter 3 Administration of Entry and Exit from National Boundary
Article 9 The set-up and closure of any customs port or frontier passageway shall be carried out after being approved in accordance with the relevant provisions of the State.
Article 10 The persons, baggage, goods and vehicles which pass the national boundary shall be accompanied with valid certificates and documents, shall pass the national boundary via the customs ports as designated by the State or the frontier passageways as agreed upon with the neighboring country, and shall be subject to the entry-exit inspection carried out by inspection units at the customs ports or frontier passageways in accordance with the relevant provisions of the State.
Article 11 With respect to persons and vehicles which need to temporarily pass the national boundary for attending frontier-defense meeting or performing other official duties, the entry-exit location and manner shall be determined in accordance with the agreement concluded by this Country and the neighboring country.
Article 12 In case any organization or individual finds that any foreign aircraft, air-floating object, water-floating object, vehicle or person illegally enters into the administrative area of this Province, such organization or individual shall duly report such situation to local frontier administration department.
Article 13 In case any person of the neighboring country and his/her vehicle enters into this Country for taking shelter owing to any Force Majeure event, such person shall immediately report to local frontier administration department, carry out activities within the scope as specified, and immediately leave this Country upon the completion of such Force Majeure event.
Article 14 The residents in frontier regions of this Country which go to the frontier regions of the neighboring country for the purpose of visiting relatives shall be dealt with in accordance with the agreement concluded by this Country and the neighboring country and the relevant provisions of the State.
Chapter 4 Frontier Administration
Article 15 The Provincial People’s Government may, in accordance with the relevant provisions of the State, demarcate frontier administration zones and forbidden frontier zones within the frontier regions.
Within the frontier administration zone and forbidden frontier zones, the special administration system will be implemented in accordance with the relevant provisions of the State and this Province.
Article 16 The establishment of cross-boundary tourism and frontier residential trade zone within the frontier regions shall, after the same has been duly approved and the relevant agreement has been concluded with the neighboring country, be carried out in accordance with the relevant provisions of the State and this Province.
Article 17 The persons from the neighboring country which enter into the frontier regions of this Country for engaging in tourism, frontier residential trade and other activities as approved may only carry out activities within the scope as approved, and shall strictly comply with the relevant provisions.
Article 18 The survey, mineral exploitation, mineral extraction, on-ground film shooting and video recording carried out within the State-designated frontal zone in the frontier regions shall be reported to the Provincial People’s Government for approval.
Article 19 With respect to the production activities such as collection, quarrying, barren land cultivation and reclamation carried out within the State-designated frontal zone in the frontier regions, all operators shall hold the Frontier Operation Certificate issued by local public security and frontier defense organs.
Article 20 Without approval, no blasting operation may be carried out within the area in this Country no more than 1 kilometer away from the national boundary and no more than 4 kilometers away from any power plant dam; no visit may be carried out on any boundary-passing bridge or river dam, and no fishing, swimming, skating or stone blasting may be carried out within the water area no more than 100 meters upstream or downstream from any boundary-passing bridge or river dam. Unless required for performing official duties, no shooting may be carried out within the area in this Country no more than 1 kilometer away from the national boundary.
In case it is necessary to carry out blasting operation within the area as specified in the first paragraph of this Article under any special circumstance, such operation shall be reported to city-level frontier administration department or, in case of relatively-large scale, be reported to provincial frontier administration department for approval. Where the blasting operation is likely to endanger the neighboring country, the neighboring country shall be informed thereof in advance.
Unless in the shooting range as specified in the relevant agreement concluded by this Country and the neighboring country, all organized live shooting exercises shall be carried out in enclosed areas. The shooting may not be directed towards the neighboring country.
Article 21 Without approval, no tree felling, sand digging or trenching for the purpose of water diversion may be carried out within the State-designated area at the bank side of the boundary river and on any island or sand bar in the boundary river. In case it is necessary to carry out the activities mentioned above under any special circumstance, such activities shall be reported to the competent departments for approval in accordance with the relevant provisions of the State and this Province, and shall be carried out in accordance with the scale, scope and time limit as approved.
Article 22 Unless otherwise specified in the relevant agreement between this Country and the neighboring country, the activities to be carried out in the boundary river, including dredging, navigation, rafting, hydrographic survey, river bank protection, water resource utilization, environmental protection, shall be reported to the Provincial People’s Government or the competent departments of the State for approval, and shall be carried out only after the relevant agreement has been concluded with the neighboring country.
Article 23 The persons who carry out rafting or hydrographic survey as approved on the boundary river shall hold the Rafting Operation Certificate or Hydrographic Operation Certificate.
Article 24 All vessels sailing on the boundary river shall comply with the relevant provisions of the State and the relevant agreements concluded by this Country and the neighboring country.
When sailing on the boundary river, all civil vessels shall, in accordance with the relevant provisions of the State and this Province, be equipped with necessary equipments and license plates, be marked with sign and number, and be accompanied with the Safety Certificate and the Operation Permit issued by the competent department at county level; all crew members shall hold the Crew Member Certificate and accept the administration from the competent departments.
Article 25 Any traffic accident involving Chinese vehicles or vessels and vehicles or vessels of the neighboring country shall be immediately reported to public security & frontier defense organs, and may not be handled without authorization.
Article 26 All organizations and individuals are prohibited to:
1. damage and, without authorization, move or dismantle any facility or marker relating to traffic, navigation, radio and TV, post and telecommunication, water conservancy, power supply, survey, frontier defense, forest protection, fire fighting or land protection located at the frontier;
2. carry out fishing by means of explosion, electric shock or poison or carry out any operation which may endanger personal safety on the boundary river;
3. carry out any operation which may contaminate the boundary river or endanger the ecological environment;
4. pass the national boundary for the purpose of carrying out collection, hunting, fishing and other activities;
5. without authorization, use any raft, floating wood or rafting tool on the boundary river;
6. without authorization, get onto any vehicle or vessel of the neighboring country on the boundary river and make trouble;
7. subsidize, accommodate, harbor or settle any person of the neighboring country who has passed the boundary illegally;
8. carry out any illegal transaction with persons from the neighboring country at the frontier;
9. carry out smuggling or drug trafficking, or purchase any article smuggled;
10. Any other activity which may jeopardize the order and security in frontier regions.
Article 27 All relevant organizations and individuals shall take measures to prevent livestock from passing the national boundary.
In case the livestock of this Country enter into the neighboring country, no individual may pass the boundary for chasing or collecting such livestock without authorization, and such situation shall be immediately reported to public security & frontier defense organs or frontier defense army and be dealt with in accordance with the relevant provisions.
The livestock of this Country returned by the neighboring country shall be collected by public security & frontier defense organs or frontier defense army, be delivered to the livestock epidemic prevention departments for quarantine, and then be disposed of in accordance with the relevant provisions.
The livestock of the neighboring country which enter into this Country shall be redriven. As for those livestock which have gone far away into this Country, any organization or individual which have caught such livestock shall isolate them and then deliver them to public security and frontier defense organs or frontier defense army for disposal of in accordance with the relevant provisions, and may not conceal, use, sell or slaughter them.
Article 28 People’s governments at various levels shall strengthen the fire-fighting works for frontier forest, and organize the relevant organizations to clean up the firebreaks at regular intervals.
Without authorization, no organization or individual may carry out manufacturing activities and other activities on the firebreaks and visibility roads.
Article 29 No organization or individual may, with any excuse, hinder the functionaries of frontier administration departments from performing official businesses.
When entering into or passing through any tourist zone, production zone or natural reserve zone within the frontier regions for the purpose of performing official duties, the functionaries, vehicles and vessels of the frontier administration departments shall be exempted from any fee, and shall not be hindered by any organization or individual.
Article 30 People’s governments at various levels in frontier regions shall arrange for the relevant departments to frequently carry out education on patriotism, internationalism, frontier policies, confidentiality regulations for cadres and masses, so as to bring the role of militia and public security committees into full play, properly carry out the joint defense involving army, police and masses, and properly take the precautions.
Chapter 5 Award and Penalty
Article 31 The organizations and individuals which earnestly implement these Regulations and make remarkable achievements shall be commended or awarded by people’s governments at various levels.
Article 32 Any organization or individual which has conducted any of the following acts shall be warned, be ordered to make rectification, and be fined from RMB200 up to RMB2,000;
1. Carrying out any operation on the boundary river without the Rafting Operation Certificate or the Hydrographic Operation Certificate;
2. Failure to mark the vessels sailing on boundary river with the sign and number as required and accompany the vessels with the Safety Certificate and/or the Operation Permit, failure of the crew members to hold the Crew Member Certificate;
3. Without authorization, getting onto any vehicle or vessel of the neighboring country on the boundary river and make trouble;
4. Subsidizing, accommodating, harboring or settling any person of the neighboring country who has passed the boundary illegally;
5. Without the Frontier Operation Certificate, carrying out the production activities such as collection, quarrying, barren land cultivation and reclamation within the State-designated frontal zone in the frontier regions,
6. In violation of the provisions hereunder, carrying out any prohibited activity on boundary-passing bridge or river dam or within the water area no more than 100 meters upstream or downstream from any boundary-passing bridge or river dam.
Article 33 Any organization or individual which has conducted any of the following acts shall be ordered to make rectification, get the illegal gains and properties obtained from such act confiscated, and be fined from RMB300 up to RMB3,000;
1. Without authorization, carrying out survey, mineral exploitation, mineral extraction, on-ground film shooting or on-ground video recording within the State-designated frontal zone in the frontier regions;
2. Without authorization, carrying out tree felling, sand digging or trenching for the purpose of water diversion within the State-designated area at the bank side of the boundary river or on any island or sand bar in the boundary river;
3. Carrying out shooting within the area in this Country no more than 1 kilometer away from the national boundary for purpose other than performing official duties;
4. Without authorization, carrying out blasting operation within any area wherein blasting operation is prohibited;
5. Carrying out fishing by means of explosion, electric shock or poison or carrying out any operation which may endanger personal safety on the boundary river;
6. Without authorization, concealing, using, selling or slaughtering any livestock of the neighboring country which enters into this Country;
7. Without authorization, concealing or distributing any air-floating or water-floating object from outside of this Country;
8. Without approval, organizing visit to boundary river, boundary-cross tourism or frontier residential trade.
Article 34 Any organization or individual which has conducted any of the following acts shall be ordered to make rectification and be fined from RMB500 up to RMB5,000;
1. Damaging any facility or marker on the national boundary owing to negligence;
2. Without authorization, carrying out any activity which is to affect or is likely to affect the stability of boundary river;
3. Damaging or, without authorization, moving or dismantling any facility or marker relating to land protection or frontier defense;
4. Carrying out any operation which may contaminate the boundary river or endanger the ecological environment.
Article 35 Any organization or individual which has conducted any of the following acts shall be ordered to make rectification, get the illegal gains and properties obtained from such act confiscated, and be fined from RMB1,000 up to RMB10,000;
1. Without authorization, using any raft, floating wood or rafting tool on the boundary river;
2. Passing the national boundary for the purpose of carrying out collection, hunting, fishing and other activities;
3. Carrying out any illegal transaction with persons from the neighboring country at the frontier;
4. Purchasing any smuggled article of which the value is relatively low;
5. Any other activity which may jeopardize the order and security in frontier regions.
Article 36 Should any functionary of any frontier administration department abuse his/her official capacity or engage in malpractices for selfish ends, administrative penalty shall be imposed on such functionary by such frontier administration department, the higher department or the competent department; where a crime is constituted, the criminal liabilities shall be investigated according to laws.
Article 37 Should any act in violation of these Regulations constitute a crime, the criminal liabilities shall be investigated by judicial authorities according to laws.
As for any organization which has violated the provisions hereunder, in addition to fine, the person in charge of such organization shall be investigated for administrative liabilities on the basis of the circumstance.
Article 38 The fine charged and the illegal properties confiscated in accordance with the provisions hereunder shall be handed over to the state treasury, except for those which are to be delivered to the neighboring country in accordance with the relevant agreement.
Article 39 Unless otherwise specified in laws and regulations, the administrative penalties as specified hereunder shall be executed by public security organs.
In case any organization or individual concerned refuses to accept the decision of administrative penalty, such organization or individual may apply for administrative reconsideration or lodge administrative litigation according to laws.
Chapter 6 Supplementary Provisions
Article 40 These Regulations shall come into force as of January 1, 1998.
