Interpretation by Jilin Province Public Security Bureau on "Views on Highlighting the Development of Private Economy"

To highlight the development of private economy is a major strategic decision of the provincial Party committee and government and an important breakthrough in promoting the reform and opening up and making the province powerful and the people rich. To conscientiously implement the requirement of the provincial Party committee and government to take highlighting the development of private economy as an important task, focus on the central point, serve the overall situation, constantly pioneer and make innovation and form a strong atmosphere to care for and support the private economic development across the province-wide public security organs, Jilin Province Public Security Bureau developed "Views to Support the Work to Serve Highlighting the Development of Private Economy" according to "Views on Highlighting the Development of Private Economy" developed by the provincial Party committee and government. Recently, the bureau's leaders made a detailed interpretation on the public security organs' support to the development of private economy.

Hereafter, the province-wide public security organs will be based on the overall situation of the province's development and revitalization, further make innovation in ideas, strive to create a safe and stable security environment, standardized and orderly market environment, fair and just legal environment and high-quality and efficient service environment and make greater contributions to promoting the province's private economic take-off. Specifically, mainly do a good job in the following four aspects:

1. Reduce and standardize administrative examination and approval projects

(1) Suppress administrative examination and approval projects. Re-conduct a comprehensive sort of administrative examination and approval projects related to the private economy assumed by the provincial public security bureau and cancel, transfer to lower levels and suspend projects that should be canceled, transferred and suspended.

(2) Simplify the examination and approval procedure and shorten the examination and approval period. Further simplify the administrative examination and approval procedure to improve efficiency. Shorten the examination and approval period furthest to improve the in-advance completion rate of administrative examination and approval. Strengthen the mass and service awareness of window staff, handle and complete procedures meeting the conditions once and inform of materials needed to be supplemented for those failing to meet the conditions once.

(3) Strengthen the work of online examination and approval. Strive to promote online reservation, online submit of documents and online examination and approval for examination and approval projects involving private enterprises, especially those needed to be co-handled by the provincial, city-level and county-level organs, to provide convenient and efficient online services for enterprises.

2. Increase the efforts to serve "key enterprises, engineering and in-progress projects and small and micro enterprises"

(1) Increase the number of served enterprises and implement the contract responsibility. The province-wide public security organs will further expand the scope of support and serving and expand the coverage and radiation on the basis of supporting and serving 12,500 small and micro enterprises in 2013. Strictly implement the contract contact enterprise system, assign duties to every contact policemen and ensure every "key enterprise, engineering and in-progress project and small and micro enterprise" to be responsible for contacting by one policemen at least.

(2) Strengthen communications and enhance the effort to serve and support and solve practical problems. Visit every small and micro enterprise supported and served one by one, provide on-door services for enterprises on a quarterly basis, solicit work comments and implement assistance measures. Start the enterprise service center and provide enterprises with business advice and services through setting up an online service platform, the official micro-blogging and individual micro-blogging of policemen. The province-wide public security organs will carry out "Centralized Services Month" in 2013 for the centralized coordination and help of enterprises in solving hard-to-development problems.

(3) Strengthen publicity to create a thick atmosphere. Carry out the activity in the province-wide public security organs to support and serve "key enterprises, engineering and in-progress projects and small and micro enterprises" and conduct centralized publicity of policies and measures of the public security sector to serve the development of small and micro enterprises and private economy to enable more enterprises to understand and know the policies and trigger and encourage all-people pioneering. Select and appoint business backbones of the economic investigation department and other departments to provide legal publicity and education for enterprises and give lectures based on economic criminal means, internal risk management and other contents on a regular basis in order to enhance the legal awareness of the management personnel of enterprises.

3. Prevent and combat all kinds of criminal activities violating the interests of enterprises.

(1) Combat economic crimes violating the interests of enterprises. For criminal cases involving misappropriation of funds, job occupation and contract fraud, infringement of intellectual property rights and other violations of the legitimate rights and interests of enterprises, dispatch elite police forces, carry out special investigations, clear up the cases quickly and restore economic losses for enterprises to the fullest extent.

(2) Protect the legitimate rights and interests of enterprises on an equal basis. Treat large and small and micro enterprises on an equal basis and protect the autonomy and equal status of enterprises in economic activities in accordance with the law. Correctly handle the relationship between punishment and protection, right distinguish the boundaries between normal business risks and illegal and criminal activities and legal and illegal behaviors and prevent from dealing with economic and financial disputes as crimes to affect the normal production and business activities.

(3) Strengthen risk prevention and control in the development of enterprises. Carry out risk assessments for the production and operation activities in time, assist enterprises to examine and verify the qualification, background information and other information of cooperative enterprises in signing and fulfilling economic contracts and extend the service tentacle. Timely collect and master the new trends on enterprise crimes inside and outside the province and inform of and make recommendations for prevention for enterprises on a regular basis. Advise enterprises to arrange the places to sign and fulfill contracts within the locals or the province to reduce and evade risks.

(4) Strengthen the internal security work of enterprises. Further improve the internal security prevention and control system "the third net", assist and guide private enterprises to establish and improve internal security systems and measures, enrich internal security forces, strengthen training and improve the self-defending ability of enterprises. Guide small and micro enterprises to strengthen internal anti-matter and anti-technology facilities and progressively realize the networking between internal video surveillance systems of small and micro enterprises and the public security organs.

(5) Do well in each stability maintenance job for enterprises. Take initiative to thoroughly investigate and coordinate to resolve instability factors, increase security patrols on the periphery of enterprises and strengthen the regulation of serious public security issues on the periphery of enterprises.

4. Create a soft environment conducive to the development of private economy with hard measures

(1) Smoothen the channels for reports and complaints. The discipline inspection and supervision department of the public security sector will conduct on-door visits to key private enterprises, engineering and in-progress projects and small and micro private enterprises, issue "police-enterprise-linked and family-guardian" supervision cards and publish the telephones for reports and complaints. Investigate and deal with reports and complaints by enterprises quickly and send feedbacks to the complainants in a timely manner.

(2) Explore the establishment of a system for the public security organs to report to the discipline inspection and supervision department on cases involving key enterprises, engineering and in-progress projects. For any investigation against the key enterprises, engineering and in-progress projects appointed by the provincial public security bureau, coercive measure taken against the legal persons and management staff, detention, seal-up, freezing and confiscation of property of the enterprises, order cease and suspend business and suspension of licenses, relevant departments and police should report to the same-level discipline inspection and supervision departments for record. Focus on the unity of legal and social effects for private enterprises especially small and micro enterprises, principally adopt education for minor offenses and keep cautious to take administrative penalty and coercive measures. Strictly prohibit from any arbitrary and double checks against enterprises with any excuse and form.

(3) Strengthen accountability. For outstanding issues damaging the interests of enterprises, such as "arbitrary charges, fines and levies" to destruct the soft environment for economic development, "hard to access, get good services, listen to nice words and deal with matters", "eating, taking, checking, asking and reporting" and "arbitrary checks, arbitrary charges, fines and levies", the discipline inspection and supervision department of the public security sector, while dealing with the person concerned in strict accordance with the law, should strictly investigate the responsibility of relevant leaders in accordance with relevant provisions.
